Welcome to Live Kenya Events. By accessing and using our platform, you agree to be bound by these Terms and Conditions, which are governed by the laws of Kenya and comply with the Data Protection Act of Kenya (as amended from time to time) and GDPR requirements where applicable.

"Event" refers to any event listed on the Platform

4. User Obligations

Users must:

Not misuse the Platform or its services
Assure that they are above the age of eighteen (18) years when accessing or using the Platform
Assure that they have the capacity to agree to be bound by these Terms and Conditions

5. Event Listings and Purchases

All event listings must be accurate and lawful. Purchases are subject to availability and our refund policy. We reserve the right to cancel or modify events due to circumstances beyond our control.

6. Force Majeure

Live Kenya shall not be liable for any failure to perform its obligations due to a Force Majeure event. This includes but is not limited to natural disasters, pandemics, epidemics, government actions, civil unrest, and terrorism.

7. Limitation of Liability

Live Kenya Events shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

8. Notification

By making a purchase on the Platform, you consent to receiving an email and text message notification related to your purchase. You may opt out of marketing communications while receiving essential Event information.

9. Dispute Resolution

9.1 We will promptly assist you in resolving any complaints regarding your use of the Platform or purchase from the Platform.

9.2 We shall attempt to resolve any dispute through negotiation for a period of fourteen (14) business days of notification of the dispute. Failure to which a party may refer the dispute to arbitration.

9.3 The dispute will be referred to the Kenyan courts for final resolution if it is not resolved through arbitration. The decision of the court will be final and binding.

10. Modification of Terms and Conditions

10.1 Live Kenya reserves the right to modify these Terms and Conditions at any time by posting notification on our website or otherwise communicating the notification to you.

10.2 The changes will become effective, and shall be deemed accepted by you, after the initial posting and shall apply on a going-forward basis with respect to your use of the Platform after the posting date.

10.3 In the event that you do not agree with any such modification, your sole and exclusive remedy is to terminate your use of the Platform.

11. No Endorsement

Live Kenya Events does not represent or endorse, and shall not be responsible for:

the safety, quality, accuracy, reliability, integrity, or legality of any product on the Platform,
the truth or accuracy of the description of products, or of any advice, opinion, offer, proposal, statement, data, or other information displayed or distributed, purchased, or paid through the Platform; or
the ability of buyers to buy products off the Platform or sellers to deliver them.

Live Kenya Events hereby disclaims any liability or responsibility for errors or omissions in any information on the Platform.
